Welcome to Vignette. These Terms of Service ("Terms") govern your access to and use of the Vignette platform, including our website, applications, and services (collectively, the "Service"). By accessing or using Vignette, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 18 years of age to use the Service. By using Vignette, you represent that you meet this age requirement.
2. Description of Service
Vignette is a photo gallery management and sharing platform that allows users to:
- Create and organize photo galleries
- Upload, store, and manage digital photographs
- Share galleries with others via links or direct access
- Access various storage tiers based on subscription level
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts & Registration
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
You may not use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content & Intellectual Property
You retain full ownership of all photos and content you upload to Vignette.
Your Rights: Vignette does not claim any ownership rights in your photos, images, or other content ("User Content"). You retain all intellectual property rights, including copyright, in your User Content.
Limited License to Vignette: By uploading User Content, you grant Vignette a limited, non-exclusive, royalty-free license solely to:
- Store your content on our servers
- Display your content to you and those you choose to share it with
- Create thumbnails and optimized versions for display purposes
- Perform technical operations necessary to provide the Service
This license is strictly limited to operating the Service and terminates when you delete your content or account. Vignette will never sell, license, or use your photos for advertising, marketing, AI training, or any purpose other than providing the Service to you.
Your Representations: You represent that you own or have the necessary rights to upload your User Content, and that your content does not infringe upon the intellectual property rights of any third party.
5. Acceptable Use Policy
Vignette is committed to maintaining a safe and lawful platform. You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you upload and share.
You agree NOT to:
- Upload content that violates any applicable law or regulation
- Use the Service to harass, abuse, or harm others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Circumvent any security or access-control measures
- Share your account credentials with others
If we receive a credible report, become aware of an apparent violation, or are required by law, Vignette may review relevant content and remove material that violates these Terms without prior notice.
6. Prohibited Content
The following types of content are strictly prohibited on Vignette:
- Illegal Content: Any content that violates local, state, national, or international law
- Child Sexual Abuse Material (CSAM): Any content depicting minors in a sexual manner; apparent violations will be reported where required by applicable law
- Non-Consensual Intimate Images: Intimate images shared without the subject's consent
- Violence & Gore: Graphic violence, gore, or content promoting violence against individuals or groups
- Hate Speech: Content promoting hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Harassment & Bullying: Content intended to harass, intimidate, or bully individuals
- Terrorist Content: Content promoting or supporting terrorist organizations or activities
- Intellectual Property Infringement: Content that infringes on copyrights, trademarks, or other intellectual property rights
- Malware & Harmful Files: Files containing viruses, malware, or other harmful code
- Fraudulent Content: Content used for scams, phishing, or other fraudulent purposes
Vignette does not routinely monitor or scan user photos for prohibited content. If we receive a credible report, become aware of an apparent violation, or are required by law, we may restrict access to or remove relevant material, suspend accounts, preserve information when legally required, and report illegal content to the appropriate authorities where required by applicable law.
7. Storage & Service Limitations
Storage allocations vary based on your subscription tier. You are responsible for managing your content within your allocated storage limits. Vignette may implement:
- File size limits for individual uploads
- Total storage caps based on subscription level
- Bandwidth limitations for sharing and downloads
- Rate limiting on API access and uploads
If you exceed your storage allocation, you may be required to upgrade your plan or remove content before uploading additional files.
8. User Backup Responsibility
You are solely responsible for maintaining backups of your content.
While Vignette employs industry-standard measures to protect and preserve your data, we strongly recommend that you:
- Maintain local copies of all photos you upload to Vignette
- Use additional backup solutions (external drives, other cloud services) for critical content
- Regularly verify that your backups are complete and accessible
- Download copies of important galleries periodically
Vignette is not a backup service. We do not guarantee the preservation of your content and shall not be liable for any loss, corruption, or deletion of User Content, whether caused by:
- Technical failures or errors
- Security incidents
- Account termination
- Service discontinuation
- Any other circumstances beyond our reasonable control
By using Vignette, you acknowledge and accept this responsibility for maintaining your own backups.
9. Sharing & Privacy
Vignette offers various sharing options for your galleries. You control who can view your content through:
- Private galleries (accessible only to you)
- Shared links (accessible to anyone with the link)
- Direct sharing with specific users
Important: When you share content, you are responsible for ensuring you have the right to share that content and that sharing does not violate the privacy rights of individuals depicted in the photos.

10. Payment Terms
Vignette offers paid subscription plans and may offer free trials, invitation-only plans, or capacity-limited introductory offers. The price, billing interval, storage allocation, trial period, and other terms shown when you subscribe form part of these Terms. For paid subscriptions:
- Billing: Subscriptions are billed in advance on a monthly or annual basis
- Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
- Price Changes: We will provide notice of any price changes before your next billing cycle
- Refunds: Refunds are generally not provided for partial subscription periods, except as required by law
- Downgrade: If you downgrade your plan, changes take effect at the next billing cycle
Launch Unlimited: When enrollment is available, eligible Studios assigned the Launch Unlimited offer receive a 30-day free trial followed by a $35 monthly subscription with every Vignette feature and unlimited cloud storage. Enrollment is limited to the first 100 activated Studios and is not complete until the offer is assigned to your Studio account. The $35 monthly rate remains in effect only while that subscription stays continuously active. Cancellation or terminal nonpayment permanently forfeits the rate, and a later subscription will use the plans and prices then available. The offer cannot be combined with another introductory discount.
You are responsible for all applicable taxes. Failure to pay may result in suspension or termination of your account.
11. Termination & Content Removal
Termination by You: You may delete your account at any time through your account settings. Upon deletion, your User Content will be removed from our active servers, though backup copies may persist for a reasonable period.
Termination by Vignette: We may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms or our Acceptable Use Policy
- You upload prohibited content
- Your account is used for illegal activities
- We are required to do so by law
- We discontinue the Service
Effect of Termination: Upon termination, your right to use the Service ceases immediately. We are not obligated to retain or provide copies of your content after termination.
12. Disclaimers & Limitation of Liability
Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGNETTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, content, or User Content
- Loss of profits or revenue
- Service interruptions
- Unauthorized access to your content
- Any other damages arising from your use of the Service
Our total liability shall not exceed the amount you paid to Vignette in the twelve (12) months preceding the claim.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date at the top of these Terms
- For material changes, we will provide notice via email or through the Service
- Continued use of the Service after changes constitutes acceptance of the updated Terms
If you do not agree to the modified Terms, you must stop using the Service and delete your account.
